What is the law for sexual assault in San Francisco?

Under criminal codes in San Francisco, sexual assault encompasses several different non-consensual sexual acts. Rape is defined as non-consensual sexual intercourse. Sexual battery is the non-consensual touching of an intimate part of another person’s body for the purpose of sexual arousal, sexual gratification, or sexual abuse. Forcible acts of penetration occur with the use of force, fear, or duress to penetrate a person’s genital or anal area.

What are the charges for sexual assault in California?

Sexual assault charges can be charged as either a misdemeanor or a felony depending on the circumstances of the attack and the impacts on the survivor. Under the law in California, a misdemeanor charge can result in jail time of up to six months and a fine of up to $2,000. A felony sexual assault charge might result in a sentence of up to four years in prison and up to $10,000 in fines.
Typically, a sexual assault will be considered a felony when there are aggravating factors or when the attack is a rape.

How long do you have to file sexual assault charges in CA?

Statute of limitations laws in California gives adult victims up to ten years after the assault to file legal charges or a civil claim. There is an exception, however, that allows victims to seek out a claim after this ten-year period when they have only just recently reasonably discovered an injury stemming from the assault.
